We provide property-related assistance, including rental property services, property sales and purchases, land and plot listings, commercial property services and connecting property owners with prospective tenants and buyers.

By accessing our website, submitting an enquiry, listing a property or using our services, you agree to these Terms and Conditions. If you do not agree with these terms, please do not use our website or services.

2. Acceptance of Terms

By viewing, enquiring about, visiting, purchasing, selling, renting, leasing or listing any property through THOZOREALTY.COM, including through our website, mobile application, WhatsApp, social media platforms, telephone or other communication channels, you agree to comply with these Terms and Conditions.

3. Nature of Our Services

THOZOREALTY.COM acts as a real estate intermediary and service provider to facilitate connections between:

• Property owners and prospective tenants.
• Property sellers and prospective buyers.
• Landowners and interested purchasers.
• Commercial property owners and business tenants.
• Landlords and businesses looking for rental spaces.

Unless expressly stated in a written agreement, THOZOREALTY.COM is not the property owner, landlord, developer, builder or legal representative of the property owner.

4. Property Listings and Information

Property information displayed on our website, social media pages, advertisements or other marketing channels may include photographs, videos, virtual tours, location details, maps, approximate or exact property locations, floor plans, descriptions, measurements, rental amounts, sale prices, deposits, maintenance charges, amenities, project details, ownership information and approval information supplied by property owners or other third parties.

We make reasonable efforts to present accurate information and may make reasonable checks; however, we do not guarantee that every detail is complete, accurate or up to date. Property availability and details may change without prior notice. Buyers and tenants must independently verify all information before making financial or legal commitments.

Property content is shared to assist genuine buyers and tenants in evaluating a property. Content remains the intellectual property of THOZOREALTY.COM and/or the respective property owner, as applicable.

5. Property Owners’ Responsibilities

Property owners submitting listings confirm that:

1. They have the legal authority or permission to advertise, sell or rent the property.
2. The information and documents supplied are true and accurate to the best of their knowledge.
3. They will disclose relevant property conditions and known legal issues.
4. They will provide correct rental or sale prices and disclose material charges.
5. They will notify us promptly if the property is sold, rented, leased, withdrawn or otherwise unavailable.
6. They will not provide misleading information or fraudulent documents.
7. They agree to pay the applicable brokerage or service fee where agreed and applicable.
8. They will comply with applicable laws and regulations.

THOZOREALTY.COM may reject, suspend, modify or remove any listing that appears misleading, unlawful, fraudulent or unavailable.

6. Tenants’ and Buyers’ Responsibilities

Prospective tenants and buyers agree to:

• Provide accurate personal and contact information.
• Inspect properties and independently verify details before entering into agreements.
• Verify the identity and authority of property owners or their representatives.
• Check ownership documents and relevant approvals with qualified professionals.
• Confirm rent or sale price, deposits, maintenance and other charges.
• Attend property visits only through scheduled appointments where arranged by us.
• Respect the privacy of owners and occupants.
• Understand all conditions before paying any amount.
• Pay brokerage or service charges agreed in writing and applicable to the transaction.

Users should not transfer deposits or advance payments without independently verifying the recipient, authority and transaction.

7. Brokerage and Service Charges

THOZOREALTY.COM may charge brokerage fees, service fees, consultation fees or other agreed charges for property-related services. The applicable charges will be communicated to the relevant customer before completion of the transaction or when the brokerage arrangement is entered into. The brokerage structure below applies unless otherwise agreed in writing.

Important: No brokerage is charged to buyers purchasing new builder/developer flats or new plotted developments marketed by THOZOREALTY.COM under the structure above. The builder/developer may pay a commission where applicable. For resale properties, 2% buyer brokerage applies unless otherwise agreed in writing. Any seller-side brokerage must be mutually agreed.

Brokerage is payable upon successful completion of the transaction or execution of the Sale Agreement, Sale Deed, Lease Agreement or Rental Agreement, as applicable, subject to the specific written arrangement. Applicable GST or other statutory taxes will be charged separately where required by law.

8. Property Introduction, Visits and Brokerage Acknowledgement

A property is considered introduced by THOZOREALTY.COM if a buyer or tenant receives property photographs, videos, property details, a location or map, owner/developer information, an owner introduction, or a site-visit arrangement through us, whether by website, WhatsApp, telephone, email, social media or any other communication.

By requesting property details, viewing photographs, watching videos, receiving property locations, scheduling or attending site visits, or communicating with THOZOREALTY.COM about an introduced property, you acknowledge that the property was introduced by us and that the applicable brokerage or service fee may become payable if a transaction is completed directly or indirectly with the introduced owner, seller, landlord, builder, developer, buyer or tenant, in accordance with the agreed brokerage terms and applicable law.

After viewing a property arranged by THOZOREALTY.COM, if the customer later purchases, rents or leases the same property directly or indirectly, the agreed brokerage remains payable where applicable.

9. Restriction Against Bypassing the Broker

Where THOZOREALTY.COM has introduced a property or connected the parties, buyers, tenants and property owners agree not to deliberately bypass THOZOREALTY.COM to avoid an agreed brokerage fee. Property owners shall not deliberately circumvent an introduction by dealing directly with a buyer or tenant introduced by us for the purpose of avoiding an agreed fee. Any brokerage obligation will be determined by the applicable written agreement, evidence of introduction and applicable law.

10. Payments and Refunds

• Payments must be made through payment methods officially communicated by THOZOREALTY.COM.
• Brokerage and service fees are payable according to the agreed service terms and applicable transaction milestone.
• Property deposits and advance payments are subject to the agreement between the property owner and the tenant or buyer.
• Unless we have expressly received and acknowledged the funds, THOZOREALTY.COM is not the recipient or custodian of deposits paid directly to property owners.
• Brokerage is non-refundable once the relevant transaction is successfully completed, subject to applicable law and the written agreement.
• Refunds of brokerage or service fees before completion will be handled according to the applicable written agreement and law.
• Applicable GST and other statutory taxes may be charged separately where required.

Users are advised to obtain payment receipts for all transactions.

11. Property Verification and Legal Due Diligence

THOZOREALTY.COM may assist customers in collecting property information and coordinating inspections. Unless specifically agreed in writing, we do not provide independent legal certification, title guarantees, structural certification, valuation certification or government approval certification.

Before purchasing any property, buyers should obtain appropriate professional advice and independently verify title and ownership, Encumbrance Certificate (EC), Patta and Chitta where applicable, approved layout and planning permissions, DTCP or CMDA approvals where applicable, building approvals and completion documents where applicable, property tax and statutory dues, litigation and other legal restrictions.

Customers should consult qualified legal and technical professionals before completing a property transaction.

12. No Guarantee of Transactions

THOZOREALTY.COM facilitates communication and introductions between property owners, tenants, buyers, sellers and developers. We do not guarantee property appreciation, rental income, investment returns, loan approval, government approvals, registration completion, continued property availability, buyer or tenant approval, or completion of any transaction. All final property decisions are made by the relevant parties.

13. User Accounts and Submitted Information

If our website allows users to submit enquiries, register accounts or upload property details, users agree to provide accurate and current information. Users must not submit false identities or contact details, upload fraudulent documents, advertise properties without proper authorization, use the website for spam or unlawful activities, attempt to access restricted systems, or copy, misuse or distribute website content without permission. We may restrict access or remove content where misuse is identified.

14. No Unauthorized Use and Intellectual Property

Users shall not copy photographs or videos, download and reuse property content, republish listings, share owner contact details obtained through our services, misuse property locations, create duplicate listings using our content, or commercially exploit website materials without permission.

Website design, branding, logos, text, graphics, photographs, videos, marketing materials and other original content published by THOZOREALTY.COM are protected by applicable intellectual property laws. Property photographs or documents supplied by owners remain subject to the rights of their respective owners.

15. Third-Party Services and Links

Our website may contain links to third-party websites, maps, payment gateways, social media platforms, messaging services and other external services. These services are operated independently. THOZOREALTY.COM is not responsible for their content, availability, privacy policies or terms of use. Users should review the applicable terms before using third-party services.

16. Limitation of Liability

THOZOREALTY.COM acts as a facilitator between buyers, tenants, sellers, landlords and developers. To the maximum extent permitted by applicable law, we are not responsible for disputes or losses relating to ownership, title defects, encumbrances, government approvals, loan rejection, construction quality, builder delays, registration disputes, incorrect information supplied by third parties, fraudulent conduct by third parties, or temporary website interruptions and technical issues.

Nothing in these terms excludes liability that cannot legally be excluded under applicable law.

17. Privacy and Personal Information

We may collect information such as names, telephone numbers, email addresses, property details and enquiry information to provide our services. Personal information will be handled according to our Privacy Policy and applicable Indian laws. Users should read our Privacy Policy before submitting personal information through the website.

18. Fraud Prevention

Fraudulent activity, impersonation, fake enquiries, misuse of listings, submission of false documents, or deliberate attempts to avoid an agreed brokerage may result in suspension of services, removal of listings and appropriate legal action, subject to applicable law.

19. Applicable Laws and RERA Compliance

THOZOREALTY.COM and its services will operate subject to applicable Indian laws, including relevant Tamil Nadu real estate regulations. Where the Real Estate (Regulation and Development) Act, 2016 (RERA) and applicable Tamil Nadu rules require real estate agent registration, the relevant activities will be undertaken only in compliance with those requirements. Nothing in these terms represents that a property is RERA registered, DTCP approved or CMDA approved unless the relevant status has been verified.

20. Termination and Suspension

We may suspend or discontinue website access, remove listings or refuse services where users violate these Terms and Conditions, submit misleading or fraudulent information, engage in unlawful activities, misuse our website or services, or cause harm to other users or our business.

21. Changes to These Terms

THOZOREALTY.COM may update these Terms and Conditions from time to time. Changes will be published on this page with an updated effective date. Continued use of our website after changes are published constitutes acceptance of the updated terms, to the extent permitted by law.

22. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by the laws of India. Subject to applicable law, disputes arising from these terms shall be subject to the jurisdiction of competent courts in Chennai, Tamil Nadu.
